| 摘 要： | 《海域使用管理法》和《物权法》对海域使用权抵押权均未置明文,但海域使用权属于法律、行政法规未禁止抵押的其他财产,可以设定抵押权。《物权法》上对海域使用权抵押权自何时设立未作规定,应当类推适用建设用地使用权抵押权和土地承包经营权抵押权设立的规定,海域使用权抵押权自登记之日起设立。现行海域使用权抵押权登记规则和实行规则应予完善。
