对向犯理论的适用：向制假者购买居民身份证的行为不应定罪

购买伪造的身份证的行为不构成犯罪是贯彻罪刑法定原则的需要;向制假者提供身份证信息并要求购买该伪造的身份证的行为不能根据刑法总则关于共同犯罪的理论认定为伪造居民身份证罪的教唆犯或者帮助犯是对向犯理论的当然适用。向制假者购买身份者的行为不构成犯罪,而是一般违法行为,但利用伪造的居民身份证从事其他活动触犯刑法的,则另行处理。

It is the result of using the principal of a legally prescribed punishment that purchasing the false ID card should not be a criminal offence. Purchasing the ID card is not a joint offence,we could not figure that the act of providing identity information to the counterfeiter and purchase the fake ID card from the counterfeiter is the instigator or abettor of crime of forgery ID card,this conclusion comes from the Theory of Symmetrical Crime. It is not a crime that purchasing the ID card from the counterfeiter,but a legal offense. It should be dealt with separately as the act of using false ID card to violate the criminal law.
