程序性辩护的理论发展与实践展开

程序性辩护与实体性辩护同属于刑事辩护的下位概念。程序性辩护是指根据案件程序事实和程序法及相关法律规定,向办案机关提出对犯罪嫌疑人、被告人有利的程序性请求,或者对办案机关的程序违法行为提出异议,要求办案机关予以采纳或者纠正、制裁,以维护犯罪嫌疑人、被告人在诉讼过程中依法享有的诉讼权利和定罪量刑以外的其他合法权益的辩护活动。程序性辩护在实践中表现为请求型、要求型、抗辩型、救济型四种类型,并且在不同诉讼阶段与实体性辩护呈现为不同的关系,其核心是掌握好程序性辩护的"度"。

The Theory Development and Practice Advancement of Procedural Defense

Procedural defense and entitative defense are both subordinate concepts of criminal defense.The procedural defense refers to the defense activities of raising procedural proposals favorable for the accused,or filing oppositions on authorities’violations on the procedure,claiming associated procedural corrections and sanctions,on the purpose of protecting the accused’s procedural rights and other legitimate interests,in addition to conviction and sentencing,based upon procedural facts,procedural laws and other relevant legal provisions.In practice,procedural defense performs in four modes,which are requests,claims,contradicts,and remedies.In different stages,the relationship between procedural defense and entitative defense behaves in different patterns.The core element of procedural defense is not to cross the line.
