| 摘 要： | 我国的现行法律对地理标志的保护存在着一些不足 ,为加强对地理标志的保护 ,应修改和完善我国有关地理标志的立法。但目前可以通过反不正当竞争法对地理标志进行保护 ,因为反不正当竞争法是商标法的重要补充 ,它可为商标法提供兜底性的保护与救济。

| Abstract: | In China, the current law has some shortcomings on protection to geographical indications. We should perfect our related legislations in order to enforce the protection of geographical indications. At present, geographical indications can be protected through Anti-unfair Competition Act as an important supplement to Trade Mark Law. It offers an overall protection and relief to Trade Mark Law. |
