人权保障机制下警察盘查制度的重构

盘查是国家基于人民警察的职责和任务依法赋予人民警察的一项重要职权，对于警察在日常治安行政管理活动中及时预防、发现、打击违法犯罪有着积极的作用。由于盘查启动的随意性，运行的任意性，尤其是超范围行使盘查权和超时限行使盘查权，导致在警察盘查中有冲击公民人身权的危险。因此应当从盘查权的启动、运行、救济方面来合理规范盘查权的行使，以实现保障公民人权的终极目的。
