法条竞合的特别关系研究——兼与张明楷教授商榷

我国刑法中的法条竞合类型,在特别关系、补充关系、吸收关系、择一关系之外,还应包括包容关系。基于行政刑法上的特别考虑,在经济犯罪中大量增加的特别法条和普通法条之间的特别关系,与传统的法条竞合论中的特别关系有一些差别。对于行为性质符合特别法条的构成特征,但因数额、数量未达到特别法条要求时,不能以普通法条定罪。此时,需要考虑立法上的预设、法益侵害原理、特别法条的立法必要性、特别法条定型化的构成要件观念、实质的刑法方法论等问题。法条竞合的排斥关系不仅仅在行为人按照特别法条和普通法条都构成犯罪时存在;在行为属于特别法条所规范的行为类型时,也具有排斥普通法适用的可能性。法条竞合与想象竞合之间具有对立关系,不存在一个行为既成立想象竞合犯又属于法条竞合的情况。
