论宪政精神之于我国的宪政建设

西方宪政基本精神包括正义、理性、自由、平等、协商、契约等价值理念。中国传统文化土壤中,宪政精神的形成先天不足。近现代宪政运动中,宪政精神的传播又后天失调。宪政建设必须在正确认识、合理转化传统观念的基础上更加注重宪政精神的树立和传播,解决传统思想文化与先进宪政理念之间的碰撞和落后的公民意识与先进的宪政设计之间的冲突,为我国的宪政发展和建设奠定更稳固的思想基础。

The basic spirit of constitutionalism of the West includes justice, rationality, freedom, equality, consultation, contracts and other values. In Chinese traditional culture, the formation of the spirit is absence. Its spread is also deficiency in modern constitutional movement. Constitutional development should pay more attention to the establishment and spread the spirit on the basis of understanding correctly and transforming reasonably traditional concepts, and resolve the conflict between the traditional culture and advanced constitutional philosophy, and between the backward civic awareness and advanced design of the constitutionalism as well, which will lay a solid ideological foundation for our constitutional development and construction.
