对中国传统宪法观念的反思与检讨——以中外宪法观念比较为视角

经济社会历史的转型决定了宪法观念的变迁和发展,而宪法观念的变迁又是宪法变迁与发展的先导。宪法观念在宪政建设中有重要作用,不同的宪法观念使人们对宪法规范的解读产生差异,由此建构起来的宪政秩序也会相异。中外宪法观念在“根本法”意义和宪法价值层面上具有很大的不同,在中国实现宪政的过程中,厘清传统的宪法观念,进而更新传统的宪法观念是当前宪法学研究的重要课题,更是中国宪政建设不可忽视的一环。

Self-criticism and Pondering on Traditional Chinese Constitutional Concept

The historic transition of economic society has determined the vicissitude and development of the constitutional concept which are the guide of the vicissitude and development of constitution.The constitutional concept plays an important role in the construction of constitutionalism.Different constitutional concepts result in people's misunderstanding of constitutional norms on which the constitutional order based also differs.There are great differences of the meaning of "the fundamental law" and the value of constitution between Chinese and foreign constitutional concepts.In the process of achieving China's constitutionalism,clarifying and thus renewing the traditional constitutional concepts is an essential task of the study of constitution which cannot be ignored in China's construction of constitutionalism.
