| 摘 要： | 过多地限制自由会导致人们的自由权利无法实现,而过少地限制自由又致使已被承认的自由受到侵犯,因此法律必须找到一个最佳的平衡点,从而以最大限度保障自由。法律有其不断追求的最高目的,同时亦具备决定其存在的最低目的。而自由最合理的限度就是要在满足最低目的基础上,最大限度地使其符合最高目的的发展方向,以此标准来确定立法对于自由的限制。

| Abstract: | To restrict the freedom redundantly can lead the freedom droit cannot be come true,and too few restrictions can bring encroachment to the freedom that has been recognized.Therefore the law must find the best balance in order to maximize the protection of freedom.The law has supreme goal by itself,and it has the mini- mum purpose in order to keep its existence.The reasonable limit of the freedom is to meet the minimum objec- tive,and make it accord with the direction of development maximatily;using this standard to determine the legis- lation of the limitations of the freedom. |
