| 摘 要： | 我国法治建设一直追求“依法求治”，注重实现法的秩序价值，而法治的真正内涵应该是“以治成法”，克服“依法求治”的工具性特点，注重法的多重价值的实现。从“依法求治”到“以治成法”的关键在于增强法律的执行力，这是目前法治建设的当务之急，也是克服“依法求治”弊端的有效途径。

| Abstract: | ＂Rule by law＂ is always pursued by our country during the course of the legal construction, mainly focu- sing on its order value. But the real demand of legal state is＂ Rule of law＂. So we should transfer from ＂Rule by law＂ to ＂Rule of law＂, and the key is enforcing the executive force of law. It is not only the emergency task now, but also a useful road to ＂Rule of law＂. |
