| 摘 要： | 军事审判权的本质历来是个具有争议的问题 ,传统观点认为军事审判权渊源于军事统率权 ,另有观点认为它具有军事统率权和国家审判权的双重渊源。根据我国的国家权力结构、审判权的特征、法律的规定及现代司法的价值取向 ,可得出国家审判权是我国军事审判权的唯一来源和本质属性的结论 ,同时军事审判权也呈现出浓厚的军事指挥权色彩

| Abstract: | The essence of military jurisdic authority is always a controversial problem. Traditional viewpoint believes that military jurisdic authority comes of military commanding power. Another viewpoint thinks it rooted from both military commanding power and national jurisdiction. Starting with the concept of military jurisdicc authority,, and basing on national power structure, the characteristics of jurisdic authority , stipulations of law and the value tropism of modern justice, this thesis points out that national jurisdic authority is the only source and essence of military jurisdic authority , at the same time ,it has distinctive style of military commanding power. |
