论知识产权的概念和特征

知识产权的概念和特征是知识产权法的基本理论问題,我国学者对知识产权的概念和特征尚未取得一致看法。知识产权是指自然人、法人或者其他组织依法对创造性的智力成果和经营性标记、信誉所享有的权利。无形性、专有性、时间性、可复制性、对世权和支配权、财产权和人身权双重属性以及依法审查确认等不是知识产权的特征,客体的非物质性、知识产权的地域性、知识产权可以分地域取得和行使是知识产权的特征。

The Concept and Characteristics of the Intellectual Property

The concept and characteristics of the intellectual property are basic theoretical questions of the intellectual property law, about which scholars of our country have not reached consensus yet. Intellectual property means the rights that natural person, legal person or other organization has owned in accordance with the law to creative intelligence achievement and business mark. The characteristics of the intellectual property are not its invisibility, exclusivity, timeliness, duplication, absoluteness or disposition, its double attribute on property and person, or its legal examination and confirmation, but that its object is not material, it is regional, and it can be acquired and exercised regionally.
