诱惑侦查的实施研究

诱惑侦查是由侦查机关设置陷阱,在诱使侦查对象犯罪或自我暴露时将其逮捕或收集证据的一种特殊侦查方法,是侦破毒品团伙犯罪等案件的一种行之有效的特殊侦查手段,一旦滥用,就可能造成侵犯人权。公安机关应当严格限定诱惑侦查适用的案件范围、适用主体、适用条件、适用程序、适用对象和原则。合法使用诱惑侦查手段,既发挥其在打击犯罪中的作用,也防止出现弊端,阻却其实施中的违法性。

Enticed investigation is a trap which set up by investigative institution, also it is a special investigating way of arresting people who enticed the object to make crime or the people who was self -exposed and collecting evidence which is an effective and special investigative way to investigate crime did by group, once it use indiscriminately, which will infringe upon human rights The public security organ should investigate cases within the limits permitted by law, suitable subject and principles, legally use ways of enticed investigation, not only giving play to its role in crime of attacking, but also its drawback too, also preventing its illegality in practice.
