证明责任法与实定法秩序的维护——合同法上证明责任问题研究

本文运用作者自己提出的证明责任法概念 ,对现行合同法领域的证明责任问题进行研究。与传统的研究方法不同 ,本文力从诉讼法和实体法在合同诉讼领域结合的角度展开论述。文中对合同诉讼的证明标准以及法律要件分类说在我国实施的可能性和必要性等问题发表了自己的见解。

On the Law of Burden of Proof and the Protection of the Substantive Law's Order--A Research of the Contract Law's Burden of Proof

In the article, the author gives the definition of the law of burden of proof, and does focus on the burden of proof in the contract law. Different from the traditional method, the author begins the argument from the connection of the procedure law and the substantive law. The method is meaningful in our country, because it pioneers new area. In the article, the author gives his own opinions on the proof standard of the contract proceeding, the possibility and requirement of the doctrine of the law classification in China.
