消费公益诉讼原告主体的扩张与完善

目前,我国提起消费公益诉讼原告范围的规定过窄,阻碍了消费公益诉讼发挥应有价值。基于公益诉讼原告资格扩张的理论,消费公益诉讼的诉讼主体呈现广泛性的特点。公民提起消费公益诉讼可以弥补“官方组织”提起消费公益诉讼的不足,充分发挥律师在消费公益诉讼中的作用。应在借鉴美国消费者集体诉讼制度的基础上,确认公民具有提起消费公益诉讼的资格。

The Expansion and Improvement of the Plaintiff Body in Consumer Public Interest Litigation

At present,the scope of plaintiffs in consumer public interest litigation in China is too narrow,which hinders the consumption public interest litigation to play its due value.Based on the theory of plaintiff qualification expansion of public interest litigation,the subjects of consumer public interest litigation show the characteristics of universality.Citizens can make up for the shortage of“official organizations”in filing consumer public interest lawsuits and give full play to the role of lawyers in consumer public interest lawsuits.On the basis of drawing lessons from the American consumer class action system,we should confirm that citizens have the qualification to bring consumer public interest litigation.
