浅议财产权天赋观念

人身权(人格权)因出生而当然获得,而财产权则因生产劳动、交易、创作、接受赠与、继承等方式方能获得。从自然状态演进到政治国家社会,人的一些本能行为被限制或剥夺,在某种意义上,人们原有的获取财产权的通道被封闭了。作为人类社会从自然状态演进到政治国家社会的代价,国家(政府)负有一种义务。从另外一个视角,即每个人从其出生之时,拥有从国家(政府)获取一定财产的天然的权利。在现实社会生活中,人们对资源的享有和占用是极其不平等的,资源享有者对资源虚无者负有一种义务。反观之,则是资源虚无者对资源享有者拥有一种天然的权利。

On the Innate Concept of Property Right

Personal rights(personality rights)are acquired by birth,while property rights can only be acquired by means of productive labor,transaction,creation,acceptance of gifts and inheritance.From the natural state to the political state society,some of people’s instinctive behaviors are restricted or deprived,in a sense,people’s original access to property rights has been closed.The state(government)has an obligation as the price for the evolution of human society from a natural state to a political state.From the other point of view,every person has a natural right to obtain certain property from the state(the government)at the time of his birth.In the real social life,people’s enjoyment and occupation of resources are extremely unequal,and those who enjoy resources have an obligation to those who have no resources.On the contrary,the resource nihilist has a kind of natural right to the resource distributor.
