| 摘 要： | 对未成年人适用罚金刑是罪刑法定原则的必然要求。然而，在司法实践中，未成年人缺乏履行能力现象的存在使法院审判陷入了两难境地。针对未成年人不同的财产状况，可以采取不同的方式执行罚金刑，同时建立罚金刑缓刑制度或罚金刑易科制度，从而达到罪刑法定与刑罚个别化的有效结合。

| Abstract: | It is necessary require of the principle of crime stipulated by the law that the fine should be applied in minor crime. While many minors are lack of capability to perform this punishments and the courts are in a dilemma. Focus on the different property conditions of minors;we should take different means to carry out the fine, and build up the probation of fine system or instead fine by other ways. It is an efficient combination of crime stipulated by the law and individual punishment. |
