| 摘 要： | 著作权犯罪是否应该“以营利为目的”，学界有“取消说”和“保留说”，我国侵犯著作权犯罪的哲学依据是“激励理论”和“社会规划理论”，这就决定了我国的著作权犯罪必须具备“以营利为目的”。
