| 摘 要： | 质疑“以事实为根据”的若干论说本身就经不起质疑。案件事实是一个没有被界定清楚的模糊概念,它不仅指客观事实,也可指确证事实和法律事实。客观事实在诉讼中不可把握,但导源于它的确证事实和法律事实具有可操作性。“以事实为根据”是支持法治的原则,我们应当在分析的基础上坚持它。

| Abstract: | The author's conclusions, who queries the principle of judging on the fact, is not convincing. It is not clear that what the meaning of the fact of law case is .It can refer to the objective fact ,and even the confirmed fact or the legal fact . We can not grasp the objective fact,but the confirmed or legal fact coming from it in a law case . The principle of judging on the fact is for being ruled by law . We should uphold it on the basis of analysis. |
