论讯问在刑事侦查中的价值再定位

传统的讯问是刑事侦查的一个重要环节和手段,它提供了大量的犯罪嫌疑人的犯罪信息,是我们破获案件、查清犯罪事实的重要依据。但随着刑事侦查科学技术的高度发展以及一些高科技仪器的运用,加之国际上对保障犯罪嫌疑人人权呼声的高涨、无罪推定价值观念的影响及沉默权、律师帮助权等配套制度的引进,给讯问的传统价值带来了很大的冲击。在现代刑事侦查中,讯问程序应是犯罪嫌疑人充分进行辩解以及与侦查机关进行理性和平等对抗的程序;应是对犯罪嫌疑人进行法制宣传和帮教转化的程序。

On the Value and Re-orientation of Interrogation during Criminal Investigation

Traditional interrogation is an important link and means of criminal investigation.It provides us with a good deal of criminal information of criminal suspects,it is an important basis for us to settle cases and find out the criminal truths.But with the high development of scientific criminal investigative technology,with the application of high-tech instruments,as well as the rising call for ensuring the criminal suspects' human rights in international society,the influence of presumption of innocence value concept and the introduction of a set of systems such as right to remain silence,right to an attorney bring great impact on traditional interrogation value.In modern criminal investigation,interrogation procedure should be a procedure which ensures the criminal suspects full defense and reasonable,fair opposition against investigation organs,and should be a procedure which can publicize legal system to criminal suspects and help to transform them.
