| 摘 要： | 就受贿罪的主观要素进行分析,探讨受贿罪故意的认识和意志因素的内容,将"为他人谋取利益"要件纳入主观要素的范畴,并将非法占有目的作为该类犯罪的隐性超过要素,进而得出在受贿罪的故意中,存在两元主观超过要素的结论,以期对司法实践作出有益探索.

| Abstract: | This article focuses on the extra subjective elements of bribery crime,it has analysed the recognizing and will factors of the subjective elements of bribery,brings "seek benefit for others" into the subjective elements,treats "illegal occupy purpose" as the hidden extra subjective elements,then comes to the conclusion that there are double extra subjective elements in the intention of bribery crime. |
