Abstract: | The system of case guidance is a newly established constituent part of China's judicial system. It is a question that deserves our exploration that whether the system of case guidance, as an emerging new matter, will be compatible with our existing system of law and legal regime. In Continental law countries, the system of precedents was subject to exclusion in the very beginning, but was gradually introduced and established as part of the legal system later on. As far as introducation of the system of precedents into China is concerned, I believe the system of case guidance being established in China will be compatible with, rather exclusive to, legislation, justice and law enforcement as well as the legal profession and legal education in the country. |
