| 摘 要： | 我国鉴定人出庭作证的法律制度尚有很多不足,构建完善的鉴定人出庭作证制度,有利于促进诉讼制度的科学化,也有利于监督鉴定结论的质量和约束鉴定人的职业操守。完善鉴定人出庭作证制度要营造良好的制度氛围,包括对鉴定结论排除制度、不出庭作证的例外情形、专家辅助人制度、对鉴定人的经济补偿制度、对鉴定人的近亲属的保护制度等;明确出庭作证的主要内容,通过交叉询问确定鉴定结论的真实性、合法性和科学性,以尽可能地揭示案件真实。
