最密切联系原则在我国的适用及立法完善

最密切联系原则是现代国际私法的一项崭新而具有强大生命力的制度，是在各国立法及实践中普遍确立和运用的一种法律适用原则。最密切联系原则的实质在于软化传统的硬性连结点，增强法律适用的灵活性，从而实现法律的根本价值——公平、正义，最大限度地维护当事人的合法权益。我国在立法上也确立了这一原则，但我国现行冲突法有关最密切联系原则方面的立法除个别法律、法规较完善外，从整体上看，立法的系统性不够，现实可操作性弱，整体水平有待提高。因此，亟待我国在今后的立法中加以完善。

Application of the Closest Connection Principles in Our Country and Its Legislative Perfection

The most closely connection principle in modem private international law is a new system with great vitality in the national legislation and practice, is generally applicable principles in the establishment and application of law. The essence of the principle is in softening the hard links point of the tradition enhancing the flexibility of application of the law in order to achieve the law＇s fundamental values - fairness, justice, and fully protecting the legitimate rights and interests of the parties. China has also established the legislative principle, but China＇s current conflict of laws principles is most closely related to legislation in addition to the individual laws, regulations, better things, from an overall point of view, the legislation ,which is not enough, realistic and week in operation, the overall standard should be improved. Therefore, the legislation and improvement in China in the future is in the urgent need.
