论法院重大敏感案件的风险评估与处置

建立重大敏感案件风险评估机制,已经成为一个不容回避的问题。本文结合法院审判实践,从经验总结的角度对敏感案件进行了归纳,并初步探讨了重大敏感案件的风险评估与处置办法。这些办法主要包括：法院要把好立案关,能够在第一时间发现敏感案件并努力促成调解;审理时要借助网络收集民意,判决结果要综合考虑政治效果、社会效果（舆论效果）;执行时争取得到当地党委政府及相关部门的支持,在善用司法建议解决敏感案件的同时提高相关部门的管理水平。

It has become an inevitable topic to build an important risk-evaluation and treatment mechanism on the sensitive cases of courts.According to the court trial practice,the paper tries to classify the sensitive cases in courts and to explore the ways to evaluate the risk of these cases and how to deal with them.The trial court should get the filing case＇s work done properly and find the sensitive cases at the earliest time and help to launch the meditation processes.During the trial processes,the trial court should collect the public opinion through websites,so that the judgments could take the social effect,political effect and public opinion effect into integrated consideration.And during the enforcement processes,the responsible judges should manage to get the support of local authorities and relevant departments.In addition,the enforcing judges should be good at using the judicial opinions to help the relevant departments to improve the level of administration.
