摘    要:正确的观念是正确理论的基础,先进的观念是先进制度的先导。我国传统劳动法学的落后首先是观念的落后,因此,只有注入权利的思维来实现劳动法研究的观念更新,具体要实现从权力本位到权利本位、国家本位到社会本位、利益一致到利益协调的观念转变,才能建立起符合市场经济要求的现代劳动法律制度。

Abstract:Corrective notion is the basis of correct theory, and advanced notion is the forerunner of advanced system. The labor law in China is out of date, and, among which the most significant is its notion. Therefore, the notion should be transformed from power-oriented to right-oriented, from state-oriented to society-oriented, from unifying of interests to harmonizing of interests, so as to establish a modern legal systems of labor in accordance with the market economy.
