| 摘 要： | 从我国目前司法现状来看,举报人、证人不愿举报、作证已成不争的事实,究其原因,最根本的是怕打击报复。这一方面反映出了人们的普遍心态,另一方面反映出了我国现行法律和制度对举报人、证人权利保护的不够。因此,完善现行的法律体系,建立举报人、证人权利保障机制,转变权力主体的司法理念,是亟需解决的问题。

| Abstract: | Viewed from the current state of the administration of justice,it has become an indisputable fact that informers and witnesses are reluctant to report or testimony.The most important reason is afraid of being revenge.This reflects the mentality of the people on one hand,and reflects inadequate protection of the rights of informers and witnesses in China's existing laws and systems on the other hand.Therefore,it is a problem urgent to solve to improve the existing legal system and build fights protection mechanism for informers and witnesses,and to change the judicial philosophy of the main power. |
