| 摘 要： | 我国现行诉讼机制对受教育权的保护范围相当狭窄或者较为模糊,立法中没有形成“权利本位”、受教育权内容设计粗疏、相关法律规则缺损。为了实现对受教育权全面的诉讼保护,必须全面解析受教育权诉讼机制存在的问题及缺陷,科学设置相关主体的法律责任,明确对受教育权进行诉讼保护的内容以及范围等。

| Abstract: | The scope and content of the action remedy about education right are very limited and vague.In legislations the right of education hasn't been valued,contents of the right of education have been designed roughly,and regulations have many gaps.In order to protect the right of education,we should find out all the problems and defects,set responsibilities rationally for the subjects of the legal remedy,and make the scope and content of the legal remedy more detailed. |
