对外来未成年犯罪嫌疑人适用逮捕措施之思考

当前我国司法实践中，导致外来未成年犯罪嫌疑人的逮捕率和羁押率始终居高不下。如何在审查批准逮捕工作中做到对城市未成年人和外来未成年人平等保护，一直是未成年人犯罪检察工作中的难题。笔者认为，应当在完善相关法律法规的基础上，进一步增强取保候审制度的可操作性，同时建立调查前置程序以及审查逮捕阶段“适当成年人”参与制度，从而最大限度地降低外来未成年犯罪嫌疑人的批捕率和羁押率，平等保护外来未成年犯罪嫌疑人合法权益。

Analysis on the Application of Arrest on Migrant Juvenile Suspects

In the judicial practice in our country,many migrant juvenile suspects have been put under arrest only because they can＇t meet the conditions for obtaining a guarantor pending trial according to the law. This results in high arrest rate and custody rate of migrant juvenile suspects. The problem of how to protect all the juvenile suspects equally and apply non -custodial coercive measures on more and more migrant juvenile suspects has always perplexed our juvenile criminal judicature over a long period of time. In the article the author claims that recognizance on bail system should be perfected hereupon on the base of perfection of relative provisions in the law and judicial interpretation, pre-arrest investigation procedure and the system of ＂Appropriate Adults＂ anticipating in the examination of arrest should be established in order to reduce the rate of arrest and custody of migrant juvenile suspects and protect their legal rights equally.
