行政诉讼与民事诉讼交叉问题的探究

行政诉讼中存在民事诉讼及民事诉讼中存在行政诉讼的行政诉讼与民事诉讼相互交叉问题常常会在在司法实践出现,对这一问题能否处理得当直接关系到能否保障行政机关依法行政,维护司法权威,使公民、法人及其他组织的合法权益得以保护。本文试通过对一起案件的分析探究处理行政诉讼与民事诉讼交叉问题的方法。

Research on the Overlapping Problems between Administrative Litigation and Civil Litigation

Overlapping problems often appear between administrative litigation and civil litigation in judicial practice. How to handle these problems properly directly relates to the implementation of administrative organs in accordance with the law, the maintenance of judicial authority, the legitimate rights and interests of citizens, legal persons and other organizations. This paper researches ways to solve the overlapping problems between administrative litigation and civil litigation by analyzing one case.
