| 摘 要： | 行政调查不仅是事后证据的收集,还包括事前信息的收集。警察行政调查出于具体执行者警察个人的意图和判断,带有很大的自由裁量性。加强警察调查权的控制,对调查行为可能存在的瑕疵事前给予充分的重视与事后完善的救济,是依法行政的要求。

| Abstract: | Administrative investigation includes not only subsequent collection of evidence, but antecedent collection of information. Administrative investigation of police depends a lot on individual intentions and judgments of the subject of the execution?policemen, so it inevitably has free right of discretion. In order to meet the need of administration by law, we should properly control the investigation right of police, attach importance to the problems probably existing in the investigation beforehand, and then perfect subsequent remedy measures. |
