西方法学的一体化运动

在当代西方法学界,自然法学派、分析法学派和社会法学派呈现出三足鼎立的态势.三大法学派彼此之间存在着激烈的学术争论,但同时也存在着相互渗透、相互融合的趋势.在此基础上,法学一体化运动应运而生.这场运动的主旨是努力促进三大法学派之间的理论融合,从而建立一个统一法学.法学一体化运动取得了一定的学术成果,但也面临着严峻的挑战.

The Integration Movement of Western Law

In contemporary western law circle, Natural Law School, Analytical Law School and Sociological Law School are showing a situation of tripartite confrontation. Despite of the heated academic arguments they have, the three schools are showing a tendency of mutual penetralion and integtation. On this basis, the Legal Integration Movement emerged, with the main purpose Io promote the theo,＇etieal integration of the three schools, thereby establishing an integrative jurisprudence. This movement has made certain aeademie aehievements, but is still lacing severe challenges.
