| 摘 要： | 刑事自诉案件立案难渐渐引起各界关注 ,检察机关对其能否行使监督职权在刑事诉讼法中无任何规定 ,这就需要让检察机关明朗其行使监督职权的可行性及迫切性 ,同时明确哪些是法院的违规操作 ,检察机关又该如何确立对策。

| Abstract: | The difficulties in filing criminal cases of private prosecution have drawn more and more attention from all walks of life.No provisions can be found in the Criminal Procedure Law as to whether or not the procuratorates may have the power to supervise this kind of cases.Therefore,it is necessary for the procuratorates to comprehend the necessity and feasibility of exercising their supervisory power on such cases.Meanwhile,it is also important for the prosecutors to make clear what are the rule breaking acts done by the courts,and how they should handle them. |
