论竞争法在知识产权保护方面的特点

知识产权法对于假冒他人注册商标、擅自使用他人企业名称、伪造产地、侵犯商业秘密等侵犯知识产权的典型的不正当竞争行为,只能从保护权利人专用权出发禁止侵权,而对保护权利主体的竞争优势、维护正常的市场交易秩序则显得力不从心。竞争法应担负起规制侵犯知识产权的不正当竞争行为的重任,发挥特殊的作用。
