| 摘 要： | 大学生打工利益受侵害事件频繁发生。对于大学生勤工俭学行为的法律性质从应然和实然角度分别进行分析，大学生具备成为劳动法中劳动者的主体资格，与用人单位存在劳动关系并满足《劳动合同法》非全日制劳动者的条件，大学生的勤工俭学行为应当受《劳动合同法》的保护。《劳动合同法》对非全日制用工的规定，对于保护非全日制劳动者的合法权益迈出了历史性一步，但在保护大学生和非全日制劳动者合法权益上还存在不足。

| Abstract: | Incidents of aggression upon the students＇ interests have frequently taken place. In this paper it will be discussed on the legal nature of college students＇ work-study program from what it should be and actually be. We agree that the students have the qualification to be the subject of laborer in Labor Law. If the relationship between the students and employing units matches the terms of part-time laborer, college students should be protected by Labor Contract Law. The part-time employment＇s rules of Labor Contract Law make a historical progress on protecting part-time laborers. But also there are some disadvantages. |
