| 摘 要： | 民事侵权行为的归责原则不仅关系到侵权责任的具体构成要件,而且关系到侵权诉讼举证责任的分配。我国特殊民事侵权行为的归责原则为过错(推定)原则和无过错原则。对民事特殊侵权行为归责原则进行系统的归类研究,厘清理论和实践界对特殊民事侵权行为归责原则的认识,非常必要。

| Abstract: | The liability fixation of tort is related to not only the specific constitution conditions of the tort liability, but also the distribution of the burden of proof in the related lawsuit. In China, the liability fixation of the special torts is presumption of fault and no-fault principle, this paper, analyzing the specific special tort, make the liability fixation clear in theory and practice. |
