摘    要:本文讨论了目前我国的劳动合同制度中在建立和稳定劳动关系方面存在的不足。并提出以下建议 :在建立劳动关系方面 ,明确规定与劳动者订立劳动合同是用人单位的义务 ;增强劳动合同制度的可操作性 ;加强建立劳动合同制度的力度。在稳定劳动关系方面 ,扩大无固定期限劳动合同的范围 ;对解除劳动合同的权利加以限制、赔偿标准加以明确。

Discussion of Two Problems on the Regulations Concerning Employment Contract
Abstract:This essay discusses two deficiencies of Chinese existing regulations in establishing and stabilizing the working relations between the employer and the employee. In establishing the working relationship, the author puts forward suggestions such as, the employer being responsible to sign a written employment contract with the emplyee, adding more procedural regulations in employment, carrying out the regulations more forcefully. In stabilizing the working relationship, the author puts forward some suggestions such as, enlarging the scope of the employment contract with no termination time, and limiting the employer's power in termination employment contract.
