| 摘 要： | 本国优先权是优先权制度的重要组成部分,国内部分学者对本国优先权作用的研究,形成三点论和六点论两种观点,其中不乏错误的结论。有必要对产生错误的根源进行分析并研究相应的法律规定,以此维护建立优先权制度的初衷,再现法律的公平理念和鼓励发明的创新精神。

| Abstract: | The domestic priority right is an important part of the priority system.Some of domestic scholars hold wrong views on the study of it,which are Three Points Theory and Six Points Theory.However,many of them are wrong conclusions.It is necessary to analyze the root causes of errors and study on relevant laws,in order to maintain the original intention of establishing the priority system,to make a representation of legal fairness and to encourage the innovative spirit in the invention. |
