| 摘 要： | 在我国针对于交通肇事犯罪活动,最高人民法院在颁布的《关于审理交通肇事刑事案件具体应用法律若干问题的解释》中对于无能力赔偿问题作了相关的理解。文章认为该种解释有不合时宜的地方,并给出了相应的建议,强调了在法律面前人人平等的精神。

| Abstract: | In China,for the crime of causing traffic casualties,the Supreme People＇s Court explained the non-payable problem on ＂the specific application of the law on the hearing of criminal cases of the traffic accident＂. This article discusses the outdated place and gives appropriate recommendations emphasized equality of people before the law. |
