| 摘 要： | 自诉制度的设立有利于对刑事案件进行程序分流,及时保障被害人权益以及提高诉讼效率。但我国现行刑事诉讼法在自诉案件的设计上存在诸多缺陷,导致自诉制度不能充分发挥其应有功能。设立人民检察院对自诉案件的介入与协助制度,有利于增强被害人对犯罪的追诉能力,有利于全面维护被害人、国家与社会的利益。 |

| Abstract: | Establishing the system of the private prosecution contributes to the diffusion of the criminal cases, and could help protect the plaintiffs' rights and interests timely and enhance the efficiency of the litigation. However, in our criminal procedure, there are some drawbacks in the designation of the private prosecution cases, which cause the function of the system of the private prosecution cannot exert efficiently. The Foundation of the system of the interposition and assistance to the private prosecution cases by the prosecution department is helpful to increase the ability of the plaintiffs, and safeguard wholly the benefits of the country, the plaintiffs and the society. |
