论商业贿赂犯罪的界定与防治对策

商业贿赂是一个全球性的问题，在我国目前表现得越来越严重。商业贿赂作为不正当竞争行为的一种，严重破坏着社会主义市场经济秩序，损害着人民群众的切身利益，败坏社会风气，也影响到党和政府的形象，并妨碍我国企业参与国际竞争。正是基于此，党中央、国务院在2006年年初作出重大决策，开展治理商业贿赂专项斗争。鉴于目前社会上还有相当一部分人对商业贿赂存在模糊认识，本文研究的目的和意义在于通过对商业贿赂犯罪涵义及相关疑难问题的研究，为刑事立法提供理论依据，为打击商业贿赂犯罪，维护正常的市场竞争秩序提供法律支持。指出了商业贿赂的危害和我国目前治理商业贿赂存在的问题，对我国如何构建商业贿赂的防治对策体系提出了几点建议。
