集成电路知识产权保护与我国的立法探析

作为人类智力劳动成果，集成电路布图设计应受知识产权保护。世界上以立法保护集成电路布图设计的国家和地区，一般采用专门立法形式。为促进我国集成电路工业的发展，保护集成电路创作者合法权益，促进集成电路技术的创新，并进一步促进我国知识产权保护的国际化、我国也以专门法的形式建立了集成电路布图设计知识产权保护制度。但其保护水平和立法层次均有待提高。

Analysis on Intellectual Property Protection of integrated circuit figure design and China′s legislation

An achievement of human intellectual labor, integrated circuit figure design should be protected by Intellectual Property. The countries or areas where make laws to protect their integrated circuit figure design, often adopt specific Intellectual Property law. In order to develop our integrated circuit industry, protect authors legal benefit who creates integrated circuit, and to improve the innovation of integrated circuit technique, go a step further, to improve our internationalization of Intellectual Property protection, China has set up its Intellectual Property protection system on integrated circuit figure design using specific law, but both its protection level and its regulation grade should be raised.
