刑事缺席审判送达规则研究——基于国际军事法庭、欧洲人权法院及黎巴嫩问题特别法庭规则

有效送达是刑事缺席审判程序得以适用的前提,是对被追诉人知情权与选择权的尊重。我国《刑事诉讼法》第二百九十二条规定的刑事缺席审判送达程序存在不足,不符合有效送达的要求。国际军事法庭、欧洲人权法院以及黎巴嫩问题特别法庭通过程序规则在刑事缺席审判中确立了有效送达原则,以审判实践丰富了有效送达的内涵,并且对有效送达的证明问题进行了探索。有鉴于此,我国刑事缺席审判送达程序应当确立有效送达原则,并从送达的时间、主体、方式、内容以及有效证明标准等维度完善配套的程序措施。

Research on The Service Rules of Trial in Absentia——Based on The Rules of the IMT,the ECHR and the STL

Effective service is the prerequisite for the application of the trial in absentia procedure,and it is a respect for the prosecuted person's right to know and choose.China's Criminal Procedure Law provides for service in criminal default trials under Article 292,which does not meet the requirements for effective service.The International Military Tribunal,the European Court of Human Rights and the Special Tribunal for Lebanon have established the principle of effective service in criminal default trials through procedural rules,enriched the meaning of effective service with trial practice,and explored the issue of proof of effective service.In view of this,China's trial in absentia service procedure should establish the principle of effective service and improve the corresponding procedural measures.
