| 摘 要： | 当前,“打黑除恶”已成为刑事斗争的“重中之重”,正确认定黑社会性质犯罪是当务之急。黑社会性质犯罪与黑社会犯罪、地方恶势力、恐怖组织、其他犯罪集团不同,需要从人数、组织结构、政治腐蚀性、渗透性、犯罪形成等方面来综合评定。

| Abstract: | It has been the focus point of our criminal struggle to fight against and eradicate the criminal syndicate and accurate determination of these crimes has become the task of top priority. Because these crimes differ from other crimes committed by criminal groups such as criminal syndicate, local gang and gang of terrorist, it should be comprehensively judged in the aspects of members' number, the organization structure, corruptive nature in politics, permeability and the styles of crime. |
