我国循环经济立法若干问题研究

推行循环经济的发展模式既是世界经济发达国家持续发展的成功之举,也是中国建设资源节约环境友好型社会的必然选择。我国经济社会可持续发展的战略需求,呼唤着循环经济立法的跟进与法制的保障。本论文针对循环经济法的立法架构、有关立法概念的定义表述、部分条文规范的设置等问题进行了分析探讨,从我国资源循环利用实践和立法可行性角度,提出了独到的见解和完善立法的相关建议。

Problems Concerning China's Recycling Economy Legislation

Encouraging recycling economy has proved a good experience of developed countries in their sustainable development.China has no choice but to get the experience where China wants to establish a society with good environment and resources saved.As such,China must quicken her legislative pace and strengthen legal protection to meet the demand of sustainable development of society.This paper observes the legislative framework,definitions of legislative concepts,and the arrangement of items in drafting the law concerning recycling economy.In perspective of recycling and reuse of resources and enforceability of law,this paper puts forward its unique ideas about the improvement of the legislation.
