| 摘 要： | 罪刑法定原则,是刑法的基本原则,充分体现了对人权的尊重.罪刑法定原则和司法实践是紧密相连的,文章分析了医生收受回扣行为的性质,认为在我国确立罪刑法定的原则,必须摆脱情理、民愤对司法的影响,正确对待法律的滞后性,树立人权神圣的理念.

| Abstract: | Doctrine of a legally prescribed punishment for a special crime is a basic criminal principle,which fully manifest respect to the human right.The doctrine of a legally prescribed punishment for a special crime is closely connected with the judicial practice,the article analyzed nature of that doctor receives the sales commission.In order to set up doctrine of a legally prescribed punishment for a special crime in our country,the influence of the general reason,the popular indignation to the judicial must be got out of,we should correctly treat the lag of law,set up the sacred human right idea. |
