论共同居住人的继续承租权

我国《合同法》第234条确定了共同居住人的继续承租权制度，然而对于共同居住人的继续承租权的性质、享受继续承租权的共同居住人的主体范围、继续承租权适用的具体对象．共同居住人行使该项权利的先后顺序等等都缺乏明确具体的规定。我国立法应该在借鉴外国先进立法的基础上加以完善，进一步明确共同居住人的主体范围．规定该权利行使的具体条件，以便更好的适用。
