农村宅基地使用权流转法律问题研究

农村宅基地使用权流转在中国目前法律框架下是不受肯定的,但是出于对土地资源的充分利用和农民合法利益的保护,流转是十分必要的,且事实上存在的地下流转市场呈失控状态。因此,立法对宅基地流转予以确认,建立良好的流转管理体制,对维护农民的利益是十分必要的。土地权利和利益的合理配置,也是实现社会公正的一个重要方面。

Research on Legal Transfer of Rights to Rural Housing Land Use

It has yet to have legal support to transfer rights to rural housing land use under current law frame- work in China.However,appropriate transfer of rights to housing land use is of great importance to harness land re- source and protect farmers' legitimate interests effectively.Relevant legislation should be put on agenda rather than simple prohibition in the face of the current run-away underground market.Transfer of rights to housing land use should be affirmed through legislation,and the sound management mechanism should also be established to protect farmers' interests.The proper allocation of land rights and interests is also an essential factor to realize social justice.
