权力监督哲学与执法司法制约监督体系建设

摘    要:从世界各国情况看,对执法司法权的制约监督,往往是权力监督的关键环节,也是权力监督理论的重点议题。在中国政法体制下,中国共产党的权力监督哲学是认知、思考和解决执法司法权制约监督问题的认识论和方法论。近年来,在中国共产党新的权力监督哲学的引领下,中国政法界深入推进执法司法体制改革,加快构建系统完备、权威高效的执法司法制约监督体系。这一体系既具鲜明的中国特色,包括党的监督、相互制约监督、内部制约监督、人民群众监督、数据监控等机制,又遵循了权力制约监督的普遍原理,内含着以制度制约权力、以权力制约权力、以权利制约权力、以科技制约权力等四大控权模式。面对快速变革的权力监督实践,中国法理学的既有监督理论应当进行重构重塑。

The Construction of the power supervision philosophy and the Restriction and Supervision System of Law Enforcement and Justice

Abstract:In the various countries in the world,the restriction and supervision of the administrative and judicial power is often the key part of power supervision,and also the main topic of power supervision theory.Under the political-legal system in China,the power supervision philosophy of the Communist Party of China is the epistemology and methodology of recognizing,thinking and solving the problem of restricting and supervising the administrative and judicial power.In recent years,under the guide of the new philosophy of power supervision of the Communist Party of China,the political-legal agencies have further promoted the reform of the administrative and judicial system,and accelerated the construction of a comprehensive,authoritative and efficient supervision system.This system not only has distinct Chinese characteristics,including the party's supervision,mutual restriction supervision,internal restriction supervision,people*s supervision,data monitoring and other mechanisms,but also follows the general principles of power restriction and supervision,such as restricting power by institutions,by power,by rights,and by science and technology.Facing the fast changing practice of power supervision,the existing supervision theory of Chinese jurisprudence should be reconstructed.
