| 摘 要： | 2008年6月1日正式实施的新《律师法》第33条在旧《律师法》第30条的基础上进行了较大的修改。一方面，从当事人一方角度看，修改后的《律师法》在一定程度上保障了当事人的人权，同时也扩大了律师在诉讼阶段的权利，使律师在侦查阶段能充分行使自己的权利。从另一方面看，律师在侦查阶段权利的扩大对检察机关办案人员在侦查阶段的侦查效率及取证方面造成了一定的影响。本文分析了《律师法》的修改对当事人一方权利的扩大及因此对检察机关侦查取证造成影响间的矛盾，并提出相关的建议。
